This legal statement contains the terms and conditions which govern the web site at www.cacm.org, cacm.org/resources/management-company-directory/, and other web sites (“CACM Websites”) owned by CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) (“CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM)”). Your use of any CACM Websites constitutes your agreement with the terms of this CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) Web Site End User Agreement. DO NOT USE OR ACCESS ANY OF THE CACM WEBSITES AND ONLINE SERVICES IF YOU DO NOT AGREE WITH THESE TERMS.
HOA Management Directory
The professional community management businesses listed in CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM)s HOA Management Directory at cacm.org/resources/management-company-directory/ (the “Directory”) have paid to be listed on this open-access, online resource. The Directory’s purpose is to help establish contact between those who need and those who offer such services; it does not imply CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM)’s endorsement of any person included. CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) does not investigate or confirm statements of expertise made by CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) members who offer their services. Professional qualifications and compensation must be discussed directly with the business whom you contact.
The Directory and the contents thereof are proprietary products of CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM). You may not use any such materials for any purpose without the express written agreement of CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM).
Communications and Unsolicited Ideas
Information delivered to the Sites (whether via posting in message boards, electronic mail, or otherwise) should not be considered by you to be confidential. CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) shall not be responsible to keep such information confidential, and CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) shall not be liable for any use or disclosure thereof. All such information is, and shall remain, the sole and exclusive property of CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) and may be used by CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) in perpetuity for any purpose whatsoever, commercial or otherwise, without compensation.

You may not use our services with the intent of hurting, damaging, destroying, or otherwise infringing on the stability and usefulness of our services. You may not distribute what California Association of Community Managers (CACM) defines as protected materials to any third party. California Association of Community Managers (CACM) reserves the right to alter, edit, or remove any data posted. You may not aggregate, package, spider, collect, display any of the content on the CACM Websites without the express written consent of California Association of Community Managers (CACM). You may not copy, duplicate or use any of the coding, markup language, or software that comprises the CACM Websites or any of its services. None of these items may be reverse-engineered or duplicated for any purpose.

No Warranties
CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) DOES NOT WARRANT OR GUARANTEE THE ACCURACY, AVAILABILITY, RELIABILITY, ACCESS TO OR UNINTERRUPTED AND ERROR FREE OPERATION OF THE SITE OR THE CONTENT. No Liability for Damages
In no event shall CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) be liable for and damages whatsoever including, without limitation, special or consequential damages, damages for loss of business profits, business interruption, loss of business information or any other pecuniary loss, arising out of your access to, or inability to access, the CACM Websites or your use of, or reliance upon, the CACM Websites or the content hereof. In addition, CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) has no duty to update the CACM Websites or the content thereof and CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) shall not be liable for any failure to update such information.
Indemnification.
You agree to defend, indemnify and hold harmless CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM), its members, directors, and employees from all actions, liabilities, losses, claims, damages, costs, and expenses including but not limited to reasonable attorney’s fees, resulting from your violation of any term of this Agreement or the use of the CACM Websites.
General Release.
You agree to release CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM), its members, directors, and employees from liability for any claims, demands, and damages (actual and consequential, direct and indirect of every kind and nature, known and unknown), arising out of your use of any CACM Websites or the content contained therein. You waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
Choice of Law; Jurisdiction and Venue.
This Agreement shall be governed in accordance with the laws of the State of California, excluding its conflict of law principles. In the event a dispute arises between you and CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM) from this Agreement or use of the CACM Websites, such dispute shall be submitted to a state or federal court with appropriate jurisdiction located in the County of Orange, California, USA.
Any term, condition, or provision of this End User Agreement that is determined for any reason to be unlawful, invalid, void, or unenforceable, shall not affect any other portion of this End User Agreement. All rights not expressly granted or addressed herein are reserved by CALIFORNIA ASSOCIATION OF COMMUNITY MANAGERS (CACM).
Competing Events.
CACM believes in the power of collaboration and works diligently to provide all members with exceptional opportunities to network at our events. Members who partner with CACM in sponsoring these events ensure that managers’ expectations are exceeded, while receiving the notoriety they deserve. When events, albeit from members or non-members, take place during (and in close proximity to) CACM events with the intent of driving CACM attendees to a non-CACM sponsored activity, it is seen as direct competition. No member, exhibitor, agent of exhibitors, employee, sponsor, associate, successor, heir or assign, may schedule any non-CACM sponsored activity, including but not limited to a hospitality suite, party (on or off event premises), activity, or any similar event during a scheduled CACM event. CACM reserves the right to decline participation in future events for individuals or companies in violation of this provision, at the sole discretion of CACM. It is CACM’s goal (and preference) to bring all members together.
