Dealing with Critters
It’s an ever-growing challenge for our communities regardless of its age or size. This session is not just about rodent and insect infestations (bedbugs, fleas and roaches), but includes a jungle of other critters including swarming bees, bears, coyotes, fowl, moles, mountain lions, and snakes.

Key Takeaways
• Who is responsible for what, e.g., the association, the owners, the residents, government agencies, vendors?
• What steps should the association follow regarding the establishment (or refinement) of policies/procedures to address these issues?
• What precautions can be taken to safeguard owners’ pets from critters as well as abatement efforts?
• How should critter episodes be appropriately documented and communicated?
• What are some “tips” for reducing critter issues?
• What are the limitations on critter control – what does the law provide?
• Who are the regulatory agencies?
• Are there notice requirements for certain critter abatement? If so, what are they?

ADA Issues Beyond Service Animals
There have been ongoing discussions focused on accommodating resident requests regarding service animals. The situations that managers deal with involve so much more. This is of particular importance given the new Fair Housing Laws that went into effect in 2020.

Key Takeaways
• What triggers ADA compliance? FEHA compliance?
• What qualifies as a reasonable accommodation?
• Who is responsible for what, i.e., the association, the owners, the residents?
• What questions can you ask and not ask?
• What are potential penalties when you get it wrong?
• What is the best approach for planning for costs that may result from unexpected compliance accommodations?

Emergency Preparedness
A managers’ view of emergency preparedness has significantly changed as communities throughout California have had to address emergencies that have included fires that have wiped out entire towns, flooding that devastated entire communities, Covid-19, protesting and looting. As the old adage says, “It’s never a problem until it’s a problem caught!”

Key Takeaways
• How do communities prepare for unknown emergencies?
• How do communities remain current on ever-changing local, state and federal mandates?
• What does an effective communication plan need to address?
• Who is in charge and who makes the calls?
• What communication systems need to be in place and with whom?
• What are effective ways to communicate with each group of stakeholders (i.e., residents, homeowners, first responders)? How often?

Implementing an Effective Code of Conduct
Implementing an Effective Code of Conduct – A growing challenge for managers is dealing with abrasive behaviors and learning to tame the beast. Whether it’s managing crowds at meetings or large gatherings at events, knowing how to handle these situations is a skill that all managers must have in their toolkit.

Key Takeaways
• How can creating a Code of Conduct effectively address abusive behaviors of board members? owners? tenants?
• How do you get buy-in from the board? from residents?

• What are the best steps to follow when creating and communicating a Code of Conduct?
• What are specific industry examples of how the Code of Conduct has been used to effectively manage harassment?
• At what point should security be called? the police?
• Can video recording be used? When is it appropriate and when is it inappropriate?
• When is it appropriate to file a restraining order? What is the process?

Everything You Need to Know About New Election Laws
Demystify the new election law requirements. Come away armed with the knowledge of how to comply with these laws when shelter-in-place and social distancing mandates create additional challenges.

Key Takeaways
• What does the review process look like with the association’s attorney?
• What do the laws require of HOAs; in other words, what can and can’t HOAs do?
• What is meant by cumulative voting? Are write-ins allowed?
• What are the defined timelines?
• What is the best process for the selection of an Inspector of Elections (professional vs. homeowner)?
• What does compliance monitoring restriction look like? How is it documented?
• What additional actions need to take place when compliance with state and local health mandates are also being implemented? (Ex. – members cannot be present to watch the opening of ballots)
• What can happen if the election is not conducted properly?

Lessons Learned During the Pandemic
Journey deep within the pandemic jungle to uncover new strategies for effective leadership and lessons learned during a time of crisis.

Key Takeaways
• What changes need to be made to accommodate the “new normal”?
• What is a board and/or manager to do when government directives require the associations to take actions that have not been funded? (ex. – not enough insurance to address new HOA risks; required items that were not included in the budget)?
• How do you enforce imposed mandates that are in direct violation of existing governing documents and when do you relax them (ex. – parking policies; operation of gyms, pools and golf courses)?
• What is considered a “reasonable” emergency contingency allowance when planning budgets given the uncertainty of the times?

Protecting the HOA from Liability
Climb aboard the safari jeep to explore risk management. This exploration will showcase the value of creating a management plan that identifies risks and provides reasoned responses that protect the community and its owners from liability.

• How do associations ensure that the plan stays timely and justifiable?
• What is the best approach to determining the right insurance(s) to secure?

• What are ways in which this plan does not get “put on the shelf” until the association is faced with a serious liability issue?

The New Work Environment
2020 was a jungle of a year requiring community managers to swing through a jungle of obstacles. There was little warning before the workplace as we knew it, changed dramatically.

Key Takeaways

• How do you manage audience participation effectively?
• How do you deal with the recording of a meeting?

Getting It Right the First Time
The transition from developer to manager continues to be a topic of great interest to the CACM manager members. It has been a requested breakout session almost every year. This year, tackle the conversation with an entirely new approach. Through the use of 2 case studies, each representing a different type of community, panel members walk through the SB 800 process, using each case study to illustrate how the law applies to community management.

Key Takeaways
• How a manager should establish a non-adversarial approach throughout the SB 800 process.
• How a manager will need to address:
o Statutes of limitation
o Builder warranty procedures
o Builder repair rights
o Communications with the builder
o Developer-controlled boards
o Owner vote requirements
o Negotiating a repair or settlement
o Utilizing a third-party

Key Takeaways

• Is foreclosure a viable option for associations to pursue in these times?
• How can associations raise revenue beyond assessments?
• What are some “tips” to help managers proactively address cashflow challenges?

New California Case Law
Learn about the new laws impacting the CID industry—what they mean, the lessons learned and how the new case law rulings will impact the way associations do business.

Navigating Capital Improvements
Your Homeowners Association is responsible for maintaining property values throughout the community. In addition, regular inspections are required in the CC&R’s, Reserve Study updates, and by SB326 and SF 604 if applicable. Capital projects often are required after completion of required inspections. So, the Board and Manager have some big decisions to make when it comes to improving the common areas and who they choose to help them with the projects.

Key Takeaways
• Why complete a Capital Improvement Project?
• What is the most effective team to assemble? We will answer the pros and cons of design professionals, construction managers, general contractors, and attorney?
• What are some examples of things that go wrong?
• What contractual and insurance issues should be considered?
